Acceptance of the terms

These conditions regulate the relationship between Lignina SA and the people who use the Lignina platform. By registering or using the service, the user declares to have read, understood, and accepted these conditions, as well as the Privacy Policy.

If you do not agree with any of the terms set out here, please refrain from registering and using the platform.

Service description

Lignina is a social reading platform. It allows users to build a personal library, keep a record of books read, in progress, or pending, write reviews, create thematic lists, and connect with other readers through social relationships within the service.

Lignina SA may introduce improvements, add new features, or modify existing ones to adapt them to the product's evolution, providing reasonable advance notice when these changes substantially affect the service.

Registration and user account

To use the features that require an account, you must be at least sixteen years old. This threshold responds to the default criterion of Regulation (EU) 2016/679 regarding digital consent and applies uniformly in all jurisdictions where Lignina operates.

During registration, first and last name, email address, country, and date of birth are requested. The gender field is optional and includes a "prefer not to say" option. The user agrees to provide truthful information and keep it updated, as well as to diligently safeguard their credentials. Each person may only have a single account.

The user is responsible for all activity conducted through their account and must notify us as soon as possible of any unauthorized access they become aware of.

Usage license

Lignina SA grants the user a personal, non-exclusive, non-transferable, and revocable license to access the service and use its features in accordance with these conditions. The license is limited to the intended purposes and does not authorize the commercial exploitation of the platform or the systematic extraction of its content.

User-generated content

The user retains ownership at all times of the content they publish on the platform: reviews, lists, comments, and their own texts. By publishing them, they grant Lignina SA a worldwide, non-exclusive, and free license to display, reproduce, and distribute them within the service and in its associated channels, to the extent necessary to provide the social features and always respecting the visibility settings configured by the user themselves.

The user guarantees that they have the necessary rights over the content they publish and that it does not infringe upon third-party rights or current laws. They are liable to Lignina SA and third parties for any claim arising from a breach of this guarantee.

Acceptable conduct

The user agrees to use Lignina in good faith and with respect for the reading community. The following uses, among others, are expressly prohibited:

  • publishing illegal, defamatory, discriminatory, or harassing content;
  • sending unsolicited communications, disguised advertising, or any form of spam;
  • impersonating another person or entity, or falsifying a relationship with them;
  • performing automated extractions, scraping, or any massive form of downloading content from the service;
  • interfering with the operation of the platform, circumventing its security measures, or attempting to access unauthorized areas or data;
  • deliberately spreading spoilers or information that ruins the reading experience of others maliciously;
  • violating intellectual property, industrial property, or any other third-party rights.

Lignina's intellectual property

The trademark, trade name, code, design, and any other integral elements of Lignina are the property of Lignina SA. Their reproduction, transformation, distribution, or public communication without the express written authorization of their owner is prohibited.

Providers processing personal data

To provide the service, Lignina SA uses two providers that may access personal data: UpCloud Oy as a hosting provider and Fastmail Pty Ltd as a transactional email provider. Full details, as well as information on international transfers and applicable guarantees, can be found in the Privacy Policy.

Modification of terms

Lignina SA may modify these conditions when necessary due to changes in the service, applicable legislation, or reasonable operational reasons. The changes will be published on this page, indicating the new update date. When they substantially affect the user's rights and obligations, they will be communicated reasonably in advance by email or through a prominent notice on the platform. The use of the service after the modifications come into force will imply their acceptance.

Suspension, termination, and closure due to inactivity

Lignina SA may suspend or cancel access to the account, with reasonable prior notice when possible, in the event of a serious breach of these conditions, misuse of the service, or when required by a competent authority. The user may, for their part, close their account at any time from the service settings.

To guarantee the principle of data minimization, Lignina applies an automatic closure policy due to inactivity: an account without a login for twenty-four consecutive months is considered inactive. From that moment, Lignina SA sends two email notices—the first thirty days in advance and a reminder seven days in advance—informing of the scheduled deletion date.

During that thirty-day grace period, the user can log in and expressly disable the scheduled deletion from their account dashboard. Simply logging in does not cancel the deletion: an explicit confirmation action is required to avoid accidental extensions of effectively abandoned accounts. Once the deadline passes without this confirmation, the account and all associated data are completely and irreversibly deleted, as described in the Privacy Policy.

Limitation of liability

To the extent permitted by law, and without excluding in any case the liability that cannot be legally limited—in particular, that arising from intent or gross negligence and that corresponding to damages caused to consumers—, Lignina SA will not be liable for indirect damages, loss of profit, or data losses that may arise from the use of the service, interruptions attributable to causes beyond its reasonable control, or content generated by other users.

Privacy

The processing of users' personal data is governed by the Privacy Policy, which forms an integral part of these conditions.

Dispute resolution, governing law, and jurisdiction

These conditions are governed by Spanish law. For the resolution of any dispute arising from their application, the parties expressly submit to the Courts and Tribunals of San Cristóbal de La Laguna, without prejudice to the right of the user acting as a consumer, in accordance with applicable regulations, to resort to the courts of their own domicile.

In accordance with Regulation (EU) 524/2013, consumer users residing in the European Union may resort to the European Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.
